• YOU ASSUME ALL RISK—reports are AI summaries from your uploads + public data, not exhaustive or professional
By using this Service, you acknowledge: RiskRadar provides informational summaries only. We make NO WARRANTIES and accept NO LIABILITY beyond the $75 fee cap. You are responsible for all due diligence and professional verification.
1. Acceptance of Terms
By accessing, using, or submitting any information to the RiskRadar website, services, or AI-assisted reports (collectively, the "Service"), you (the "User") agree to be bound by this User Agreement (the "Agreement") and all incorporated policies, including our Privacy Policy. This Agreement forms a legally binding contract between you and RiskRadar, LLC (a Montana limited liability company owned by [Your Name] and Alex, hereinafter "we," "us," or "our"). If you do not agree to these terms, do not use the Service. Your continued use constitutes ongoing acceptance.
For enforceability, you must affirmatively acknowledge this Agreement via checkbox or "I Agree" button before submitting requests or payments—failure to do so voids any access. We reserve the right to update this Agreement with 30 days' notice via email or site posting; continued use post-update binds you. If changes materially affect your rights, you may terminate use without penalty.
2. User Obligations and Restrictions
You agree to use the Service solely for lawful purposes and in compliance with all applicable U.S. laws, including Montana consumer protection statutes (e.g., MCA 30-14-101 et seq.). As a User, your obligations include:
- Providing accurate, non-proprietary data (e.g., MLS listings, PDFs, photos) for AI processing; you warrant that uploads are legally obtained and do not infringe third-party rights (e.g., MLS copyrights per NAR guidelines).
- Not using the Service for illegal activities, harassment, spam, or reverse-engineering our AI.
- Acknowledging that reports are AI-generated summaries of your inputs/public data, flagging potential risks (e.g., septic, zoning) for informational use only.
- Prohibited behaviors: Uploading harmful code, misrepresenting data sources, relying on reports as professional advice, or reselling/sharing outputs commercially without our written consent.
- If registering (e.g., for subscriptions), maintain account security; notify us immediately of breaches at support@riskradar.rip. Violation may result in immediate suspension, data deletion, and legal action. You indemnify us against claims from your misuse.
3. Intellectual Property (IP) Rights
All content, AI algorithms, and trademarks (including "RiskRadar" and "WE CATCH RISKS, YOU CHECK THEM") are owned by us or licensors, protected under U.S. copyright (DMCA), trademark, and IP laws.
Your License to Reports
We grant you a perpetual, non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute the AI-generated reports we deliver to you for any lawful purpose, including commercial use (e.g., sharing with clients, lenders, or colleagues). You may not:
- Remove copyright/attribution notices from reports.
- Misrepresent reports as professional inspections, appraisals, or legal advice.
- Reverse-engineer our AI algorithms or training data.
- Resell reports as a competing AI risk assessment service without written permission.
Our Rights to Improve Service
Your uploads (documents, property data) grant us a limited, non-exclusive license to process, analyze, and aggregate anonymously or in de-identified form only to improve the Service, train AI models, and generate insights. We do not claim ownership of your uploaded content and will not share identifiable property data with third parties except as required for report generation (e.g., public records lookup) or by law.
Platform IP Protection
The RiskRadar website, software, and underlying AI technology remain our exclusive property. You may not copy, modify, distribute, or create derivative works of our platform without express permission. We comply with DMCA takedown notices; submit counter-notices if needed.

4. Termination Clause
We may terminate or suspend your access immediately, without notice or liability, for any reason, including breach (e.g., false data uploads) or at our discretion. Upon termination:
- All licenses cease; delete all reports/materials.
- Outstanding payments remain due; no refunds.
You may terminate by ceasing use and notifying us. Surviving sections: Disclaimers, Liability Limitations, Indemnity, Governing Law.
5. Governing Law and Dispute Resolution
This Agreement is governed by Montana law (MCA et seq.), without conflict principles. Venue: Exclusive in Montana state/federal courts.
Binding Arbitration
Disputes (e.g., over report accuracy) resolved via binding arbitration in Montana under American Arbitration Association rules, not court. You waive jury trials; arbitrator decisions final. Costs: Each party bears its own; we cap yours at $75 if you prevail.
Class Action Waiver
No class/collective actions; disputes individual only—enforceable per Montana/U.S. precedents (e.g., AT&T Mobility v. Concepcion).
Informal Resolution First
Contact us at support@riskradar.rip for 30-day good-faith negotiation before arbitration.
6. Payment and Billing Details
Reports cost $149 each (or future tiers/subscriptions); payments via Stripe/PayPal, non-refundable except for undelivered reports (refund within 7 days). Auto-renew for subscriptions (cancel anytime via account). You handle taxes/fees. No liability for payment errors (e.g., invalid cards). Future pricing changes with notice; disputes via arbitration.
7. Privacy Policy
Incorporated by reference (link: Privacy Policy). We collect minimal data (e.g., uploads, emails) for Service delivery, compliant with Montana's SB 297/384 (data privacy). No selling data; secure deletion post-report. EU/CA users: GDPR/CCPA rights apply.

WARRANTY DISCLAIMER
Service provided "AS IS" and "AS AVAILABLE" WITHOUT WARRANTIES (EXPRESS/IMPLIED, INCLUDING MERCHANTABILITY, FITNESS, ACCURACY, COMPLETENESS). NO GUARANTEES reports are error-free, timely, or reliable—AI may miss/err (e.g., drought data outdated). NOT A PROFESSIONAL INSPECTION/ADVICE; consult licensed experts (e.g., inspectors, attorneys) before decisions.
LIMITATION OF LIABILITY
WE ASSUME ZERO LIABILITY FOR DAMAGES (DIRECT/INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, INCLUDING LOSSES FROM RELIANCE, ERRORS, OMISSIONS) ARISING FROM SERVICE USE, TO FULLEST EXTENT PERMITTED. TOTAL LIABILITY CAPPED AT $75 (YOUR FEE); NO LIABILITY FOR INVESTMENT LOSSES, PROPERTY DAMAGES, OR THIRD-PARTY CLAIMS. YOU ASSUME ALL RISK—WE CATCH RISKS, YOU CHECK THEM.
PROFESSIONAL ADVICE DISCLAIMER
Reports reflect AI aggregation only, not our opinions/advice. NOT LEGAL/FINANCIAL/REAL ESTATE GUIDANCE; no professional-client relationship. Verify with experts—e.g., perc tests for septic risks. WE ARE NOT AN INSPECTION COMPANY; reports flag red flags to save time, but mandate independent due diligence/inspections.
ERRORS AND OMISSIONS DISCLAIMER
